• born in Cornwall, England on 6th August,1758 to parents John Brabyn (1732-1759) and Joanna Jago, both of Cornwall, whom had married in 1752.
• “According to family tradition, he was the younger of two sons, and lived on a small farm with his widowed mother. One day, while visiting the local market town, John's brother was picked up by a recruiting sergeant and signed on to serve in the army. When his mother found out, she went to see the recruiting officer and requested her son's release, as she depended on him to run the farm, and offered John in his place.” John entered the army in 1778.

• hmm… to have lost his father at age 1yr old, then to be effectively rejected by his mother, no wonder he decided to come to Australia (if he had a choice), what else did he have to lose… oh, yes … his wife and then his eldest son…

• during military service in Flanders, legend has it that he saved the life of the Duke of York.
  • “By virtue of his size and strength, was a member of the Duke's personal guard. When the Duke's horse was shot from underneath him on the battle field Brabyn rode past and lifted the Duke onto his own horse and carried him to safety. Olive Mills claims that “In return for his service, the Duke promised him that his son, who was born on the field of battle in Flanders, should, on coming of age, receive a commission in the army.” If this is so, then he failed to keep his word, for his son John Frederick Brabyn joined the H.M.S. Lady Nelson in 1801 as a “Boy, 1st. Class”. A sword that was Brabyn's, and was in the possession of the family for many years (until stolen), bore the Royal Coat of Arms, and gave rise to the legend that this was presented to him by the Duke. This may well be so, but it could also be that the Royal Coat of Arms was commonly attached to military arms and regalia. The family stories have him visiting the Duke of York on his visits to England (he went in 1811 and 1815), and the Duke was said to have interceded on his behalf - but since Brabyn failed in his objective to get out of the army, his influence seems negligible in an area where royal patronage would be likely to carry weight. Brabyn's residence in Windsor, “York Lodge”, may well have been named to perpetuate a connection with the Duke of York, but there is no such dedication in existence today. ”
• he left Cork, Ireland on 9th August 1795 aboard the Marquis of Cornwallis in charge of a detachment of the NSW Corps as Ensign John Brabyn of the 12th Regiment of the NSW Corps (later named Royal Veteran Company) carrying 163 male and 70 female convicts. During the voyage a mutiny broke out & John Brabyn gave evidence in the subsequent court hearings on 12th March 1796. The ships passenger lists includes “Brabyn Mrs Mary and her two children, John and Jennifer”, and his wife Mary was the 1^st white free woman to die on Norfolk Is. (1796) - she died within a week of them arriving on Norfolk Island.
  • debate exists regarding who this Mary was who boarded the ship to Australia as his wife and mother of his two children, John Frederick and Jennifer Ann:
    • an Irish convict Mary Allyn who he supposedly took as his concubine (but there was no Mary Allyn or similar name on the passenger list), or perhaps more likely,
    • a Spanish lady called Marya (Marya Marta Manuela Soria SERRANO (1761-c1795) d. of Cristobel Marta Sarlanga and his wife, Josefa Soria Serrano of Saragossa/Zaragoza, Aragon, Eastern Spain and who is thought by some that she was at one time attached to the Spanish Court known as Lady Mary) whom he supposedly met in Flanders, and whose parents built a monument to her in Spain on hearing of her death, if this is true, perhaps, the family silver given to Jennifer was her dowry.
• arrived in Sydney Cove, Port Jackson on 11th Feb. 1796, only 8 years after the first white settlement of the Colony of New South Wales (ie. the first white settlement of Australia)  by Governor Phillip in 1788.
• he was later promoted to Lieutenant & then to Captain & was known as a man of judgment, tact & ability who held important & honourable positions as a member of court at several notable trials resulting from conflict between important civil & military personages, and the governors.
• In 1796 on his arrival in Australia John Brabyn was granted the lease of 19 acres on Norfolk Island by Governor John Hunter, which he now cultivated and also became a trader, though unlike most of his fellow officers, he did not trade in rum, having seen the misery caused by alcohol during his army service. It seems he arrived on Norfolk Island on 2nd April 1796, and his wife Mary, died there on 29th April 1796.
• On the 15th of August,1800 John was promoted Lieutenant and returned to Sydney Town, and from there he continued on to Cornwall in England to bring  his seven year daughter Jennifer Ann back to Australia.
• John's brother George, the eldest son was now the owner of the Brabyn family farm at Pelynt, and in 1780 George had married Sarah Medlands in Cornwall and they were now the parents of a son. 
• John and his daughter Jennifer Ann returned to  Sydney with the family silver which was John's heritage, sailing on the ship “Hercules” and it was here that John met the Irish woman Sarah DENNISON  (also called herself Sarah HOWARD and Sarah ELLIOT) who was said to be the wife of Bernard (Barney) Dennison an Irish convict who had come to Australia on the ship “Martha” to New South Wales in 1791.
• he sat with the judge-advocate in connection with the Paterson-Macarthur duel on 4th Sept, 1801.
• he was given a further grant of 200 acres by Governor King in 1801.
• in 1802, he married Sarah Elliott (1768-1847).
• he was a member of the court in the trial of D'Arcy Wentworth for contempt in 1807.
• he sat with the judge-advocate in the trial of John Macarthur (the one who brought merino sheep to Australia) in 1808.
  • “Brabyn played an important part in the events leading up to the deposition of Governor Bligh in January 1808, for he was a member of the court whose actions at the trial of John Macarthur precipitated the governor's “arrest” by the military.”
  • “Macarthur, the most powerful and arrogant of the officers, though by that time he had retired from  military service, was on trial for sedition in refusing to pay a fine. When Macarthur refused to be tried and the six members of the court bench, including Brabyn, supported him, Governor Bligh was furious and declared he would gaol them all. In consequence, between Macarthur, the six officers, and Major Johnston, a plot was launched and a military coup carried out on 26th January 1808, later known as the “Rum Rebellion”. Bligh was imprisoned, Johnston declared himself Governor and Macarthur Colonial Secretary. The officers made huge land grants to each other, and most of the civilian positions passed into the hands of the military. That Brabyn played only a supporting role is evident in that he received no land and no immediate position.  By continuing to side with Macarthur after the “rebellion”, he incurred the wrath of Major Johnston and was assigned to Van Dieman's Land.”

• he was detached to Tasmania as Commandant at Port Dalrymple, Launceston from Dec. 1808. 
• his 14 yr old eldest daughter Jennifer married Peter Mills, in Port Dalrymple, 1810. 
  • I am guessing there may have been conflicts between Jennifer and her step-mother as:
    • she married at a young age of 15, although this was probably common then, but perhaps it was also to escape a Cinderella scenario of living with a step-mother and two younger step-sisters while her father may have been too busy to devote much time to her.
    • it does not seem that her father returned to see her again after 1810, even though she became destitute and a widow.
    • given that she named her first son after her father, presumably the conflict wasn't with him.
    • her husband, Peter Mills was a friend of Gov. Bligh, the man whom John Brabyn had opposed in the Rum Rebellion.
    • John Brabyn's will and secret grant of land to his grandson, dealt very unfairly with Jennifer who only received a silver cutlery set as part of the will, a will dated the day after he died.
  • as an aside, could there also have been a conflict between John Brabyn or his wife, with his son John Frederick:
    • John Frederick left his father and step-mother in 1802, joining the Lady Nelson, perhaps in response to his father's re-marriage - this is pure speculation on my part, but given the coincidence and the latter circumstances around Jennifer, I wonder if his step-mother created conflicts?
• he is said to have been the better of a bad lot of Commandants who were mostly ineffectual as administrators & were chiefs of a colony racked by fraud, deficiencies in stores, quarrelling, & maladministration.
• he was replaced as commandant and administrator of the county of Cornwall in January 1810 by Major Gordon and returned to Sydney.
• after military rule in NSW was abruptly ended to be replaced by Macquarie and his own troops to restore legitimate government, in March 1810, he went to England  with the officers of the disbanded NSW Corps for trial. He was left unpunished for his part in the Rum Rebellion, as were most of the other officers, and in less than a year, he was put in charge of the NSW Veteran Company, and in 1812 was back in Sydney via the Guildford.
• in 1817? he was granted leave to visit Europe, and on his return, he was detached to Parramatta, NSW from 1821-1824 when he retired from active service.
• he died at “York Lodge”, Windsor, NSW on 3rd August 1835 & was buried in the old Windsor Cemetery.
• after his death, a notice was issued in the NSW Government Gazette, 1 Aug. 1839, of a grant of land of 800 acres in the Parish of Vane, County of Durham, NSW. This was conveyed to his son-in-law, Charles Marsden to hold in trust. On Sarah's death in 1847, her sole executor of her will was Rev. Thos. Hassell. This notice of land was not made known to his eldest daughter in Tasmania who was Sarah's step-daughter, and it was his youngest daughter of Sarah who had married the Rev. Samuel Marsden's son who took control of the grant. (Rev. Samuel Marsden was a noted clergyman, the second minister to arrive in the colony).

• at thirteen, he was a member of the Lieutenant Murray's crew on The Lady Nelson, possibly as a mid-shipman, which, in 1802, discovered the entrance to Port Phillip Bay (the entrance to the bay on which the city of Melbourne was later founded).

• during this trip his alertness saved the crew from spears thrown by the local Aborigines with whom he, as part of a boarding party were trading goods, becoming Victoria's first “boy hero”. He was present when Lieutenant Murray took formal possession of Port Phillip for England.
• when returning to England, it was supposed by his family to have been captured by Spaniards & to have spent his life toiling in the silver mines of Peru - a similar fate ended the career of George Bass (of Bass & Flinders fame), the surgeon to HMS Reliance, who with Matthew Flinders made important coastal discoveries around Australia.
• NB. a settlement at Sorrento was established in 1803 but this failed and was moved to Hobart.

Peter Burnett French MILLS

• married Lieutenant Peter Burnett French Mills (1786-1816?), my great, great, great, great grandfather
  • Peter's father was a businessman in the silk trade in Dublin, his brother a doctor of medicine.
  • Peter chose a Naval career, and in Feb 1804, became an able seaman on the Hazard and soon transferred as a midshipman to the Warrior under Capt Bligh.
  • At 19yrs of age, he was chosen by Captain Bligh to man the HMS “Porpoise” to Australia in 1805, arriving in Port Jackson in 1806.
  • After the Bligh rebellion, he is said to have acted as secretary to Bligh and was recalled to London to give evidence at Major Johnston's trial after the governor was deposed.
  • in July 1807, Peter was sent on the Estramina to be stationed at Port Dalrymple and occupied the position of Pilot & Harbour Master for a short period.
  • He married Jennifer Ann Brabyn 1810 two weeks after the 1st ever wedding in Tasmania. The marriage was solemnized by the Rev. Robert Knopwood (who was the Rev. North in Marcus Clarke's famous book, For the term of his natural life.)
    • the 1st wedding in Van Dieman's land was of Marine Sgt William Gangell who had came out on the Calcutta. His descendants include Heather Kay who supplies me with additional information for inclusion on this website.
  • He bore 3 children there.
  • With a Dr Jacob Mountgarret sustained financial trouble:
    • “In January 1812, the brig Active arrived from Calcutta. The vessel, owned by J B McHugo, was loaded with luxury stores, tea, sugar and spirits, etc. McHugo professed to be a member of the Royal Family traveling incognito. Mills and others purchased luxury items from McHugo to the value of £667 and Mills was having trouble paying back his creditors.”

  • He was also the deputy surveyor but after litigations resulting from his mistakes, he was suspended in June 1812 by Gov. Macquarie, losing his entitlement to a land grant of 200 acres but allowed to become a settler with rations for his family and assigned servants.
  • In 1814 to escape his creditors, he went bush for some time and formed a bushranging gang with the deputy commissary, George Williams and several convicts.
    • in May, 1814, Gov. Macquarie issued a proclamation calling for surrender of Peter Mills and others with promise of pardon for all offences other than wilful murder (see here).
    • “They stole the government boat from Low Head intending to sail to King Island, but the boat was wrecked at the second Western River (River Mersey) and Mills returned overland to Port Dalrymple and surrendered to the authorities. He was placed in irons in the guardhouse at Launceston.”
    • Mill's wife brought rum (supplied by Mountgarret) at 1am for the guards and this allowed Mills to escape but he was soon found again in a stable. At his trial in Launceston he was committed to the Supreme Court in Sydney along with Mountgarret. Due to delays in his case being processed and lack of evidence, they were discharged after promising to behave and he returned to his family.

  • in October 1816, he finally disappeared on the “Adamant”, although in Olive Mills' book, he disappeared on the “Bella”.

• after many of the husbands of the local farms in Launceston were killed when the ship Bella was wrecked, the wives were left to fend off attacks by Aborigines who killed a neighbouring farmer & another neighbour's wife.
• Jennifer later had a relationship with James Tait (Tate), to whom she bore 2 children - George in 1821 & Isabella later in 1833.

• Victoria's 1st settlers, the founders of Port Fairy, Victoria and highly respected seamen, champion boat-steerers, ploughmen & whalers:
• John & Charles were strong sailors who, having been given charts & a glowing account of a bay on the south-west coast of Victoria by Capt. James Wishart who discovered it in 1810 when he had to seek shelter from a storm & who had named it Port Fairy after his little cutter Fairy, decided to migrate there in 1826. Their voyage in small vessels was a feat of seamanship, endurance & abilities given the treacherous seas. They founded a settlement there and in 1832, they joined a whaling shore party to Portland Bay under Capt. Young. They set up huts in Portland and William Dutton was in charge of these huts while they were away whaling and the Henty brother arrived to “discover” Portland in 1834. The whalers then moved along the coast, with the Mills brothers preferring Port Fairy where they combined farming with their whaling operations, and Charlie saved many lives from shipwrecks including the Sarah Louisa at Port Fairy in 1849. John became friends with Capt. Campbell (after whom Port Campbell is named - the site of the famous Twelve Apostles coastal formation) on his whaling voyages to New Zealand on the Mars in 1835 and prior to 1836 commanded the historic schooner, Thistle, Henty's vessel and taking John Batman with him, it became the 1st craft to navigate Melbourne's river, the Yarra as they searched for possibilities of a settlement. It was on this occasion, on reaching Fairfield, that John Batman remarked “This will be the spot for a village”, and hence the development of Melbourne. The 1st ship to sail from the United Kingdom with immigrants direct to Port Phillip was the 600 ton David Clarke commanded by Capt. J.B.Mills, arriving on 27th Oct 1839 when the population of Port Phillip was 4000. During this trip, Capt. Mills stayed 14 days in Rio De Janeiro after their water & stock replenishment stay had to be prolonged as 8 of the Liverpool Irishmen had landed themselves in gaol for 8 days and their fines had to be paid for by Capt. Mills. From 1843-49, he carried cattle & merchandise between Port Fairy & Launceston aboard the Essington which he owned until it was wrecked by striking her own anchors wrecking him financially. John retired from coastal trade and in 1851 became harbour master of Port Fairy which he retained until 1871. John also discovered the famous now lost “Mahogany” shipwreck giving the first detailed account in 1843 (see here). In Aug. 1844, Charles was one of seven men who were the 1st to enter the port of Warrnambool. On one occasion, Charles' boat was smashed by a whale in rough seas, Charles placed one crewman with a broken leg on the upturned boat along with a second who could not swim, while he and a Aborigine swam 2 miles to shore for help, unfortunately, the Aborigine drowned while Charles arrived safely having fended off two sharks. The historic homesteads of the Mill's brothers are famed landmarks in Port Fairy today.

• on 3rd Feb. 1830, married James Glare, my great, great, great, grandfather.
• James was born in Middlesex, England circa 1803, a convict transported from England to Launceston in 1820 aboard the Lady Ridley for theft of a 5 pound note, and who received conditional pardon in 1836 and full pardon in 1846. By 1840 he & his wife had acquired land in Brisbane St, Launceston.
• James migrated with his wife, family and mother-in-law to Port Fairy in 1846 where he became a farmer, carrier & bridge builder who sometimes went whaling with the Mills brothers,  and settled on land that Charles Mills had sub-divided in Port Fairy to allow them to be nearby. They later moved to Ellerslie near Warrnambool.
• Eliza bore 6 children whilst in Launceston and 4 more in Port Fairy
  • 1 of her children was lost in the bush and never found.
  • her eldest child, John Glare (1831-1910) is my great, great, grandfather who married Frances Anne Lowe, my great, great, grandmother, in 1850.

• Sarah was the widow of a free settler who had died on the voyage out from England
• after returning from Cornwall to Sydney in 1810, he and his family with Sarah settled in Sydney leaving his presumably estranged oldest daughter, Jennyfer Anne “Jane” and her newly married husband, to fend for themselves in Van Dieman's land, while his only son, sailor “Boy” Brabyn had been presumed to be captured and enslaved by Spaniards.

• John Gaggin arrived from Ireland in January 1819 on board the Globe. He was employed as a storekeeper in the Commissariat Department at Windsor.     • “While serving in Flanders, Capt John Frederick met the Spanish girl, Marya Marta Manuela Soria Serrano,daughter of Cristobel Marta Sarlanga and his wife, Josefa Soria Serrano. Marya Marta was born on the 24th March,1761, at Zaragoza/Saragossa in Eastern Spain.One member of the family is adamant that Marya Marta was at one time attached to the Spanish Court known as Lady Mary. However this possibility has yet to be explored.
    • Two children were born to Marya Marta and John Frederick in Flanders where war was raging. John Frederick Junior was born in 1788, and his sister Jennifer was born in 1794 (?). Sadly Marya Marta died soon after the birth of Jennifer.
    • John now took his daughter to Pelynt to his mother Joanna Brabyn where Jennifer live until she was 7”
